Terms and Conditions
“The Company” refers to “Ansteys Healthcare” “the Customer” means the individual, practice, firm, company, or other party with whom the Company contracts. This agreement is applicable to all goods and services supplied in Australia by “the Company,” whether ordered from this website or otherwise and supersedes or cancels all previous printed Terms and Conditions of Sale.
1. CUSTOMER CONDITIONS.
These conditions apply to any contract of sale between the Company and the Customer to the exclusion of any different terms and conditions issued by the Customer, except insofar as the Company and the Customer may have otherwise agreed.
2. PRICES.
While every effort is made to maintain prices, the Company reserves the right to alter prices without notice at any time before delivery, to reflect increases imposed by manufacturers and when currency exchange rates adversely affect the cost of imported goods. All prices are in Australian dollars.
3. G.S.T
Prices are inclusive of G.S.T at 10% (where applicable). All amounts set out in this website include GST (where applicable), and all final invoices will include a GST breakdown. However, most Medical Products are GST exempt. If you believe that you are GST exempt, please discuss this with us by email or telephone on (02) 4952 4155.
4. FREIGHT.
Freight and packing will be charged on all orders and is a sliding scale fee dependant on the size and weight for either posted items or courier delivered items. For posted items we use express post, if you wish to insure your items against damage or loss please inform Ansteys at the time you place your order. Insuring your item will incur additional fee’s.
5. PAYMENT.
Full payment must be made at the time of purchase or the sale will not be finalised and the goods will not be shipped out. The Company reserves the right to investigate any sale over the amount of $500 paid via credit card to avoid fraudulent transactions. 100 points of I.D will be required when placing any order at or above this amount.
6. DELIVERY.
Only orders for delivery within Australia are accepted. Orders received before 12 noon will usually be shipped within the next 2 working days of your order being placed. All orders will include a non-refundable postal and handling fee per order. This amount is a sliding scale rate for all mailable items. For delivery via a courier service of large goods that do not fit inside postage satchels there is also a sliding scale delivery rate.
7. SHORTAGES, DAMAGES AND NON DELIVERY.
Once an item is posted out via Australia Post mail services or with our courier company it is no longer under the control of Ansteys Healthcare and therefor we accept no responsibility for lost or damages goods, items being posted or couriered out are dispatched at the sole risk of the buyer. We keep records (tracking numbers) for all posted and couriered items which we will happily supply for tracking purposes, however, any further investigation needs to be taken up with Australia Post or the courier company by the buyer.
8. AVAILABILITY
All products offered on this website are subject to change and availability. Ansteys Healthcare will endeavour to keep stock levels as up to date as possible. Anything out of stock will be listed as out of stock or on back order.
In the event that a product should become unavailable, due to unforeseen circumstances, an Ansteys Healthcare customer service representative will contact you in person within the next working day of your order being placed to confirm a delivery date of the back ordered product. You can choose at this point to wait for the delivery or cancel the delivery with no fee’s incurred.
9. RETURNED GOODS
For hygiene purposes there are no refunds or exchanges for any surgical garments or medical devices, so please ensure that when you order these items online (without trying them on) that you choose wisely –

Ansteys Healthcare are obliged to ensure that all goods sold –
- are of merchantable quality – that is, goods need to reach a basic level of quality given the price of the goods and any description that is provided with the goods
- are fit for the purpose or job that the consumer described to you or that are self-evident
- match any description or sample given to the customer whether in promotional material, over the phone, in person, on a website or on labelling or packaging
- are free from defects and faults
Ansteys Healthcare is not obliged to refund, credit or exchange non surgical garments if the customers has –
- changed their mind, decided they no longer want the goods or just don’t like them, or found that goods are the wrong size or colour
- found they can buy the same or similar goods elsewhere for a cheaper price
- examined goods before buying them and should have seen any fault at that time
- had a defect drawn to their attention before they purchased goods, for example, when goods are clearly labelled as seconds or faulty
Ansteys Healthcare customers are entitled to a refund, credit or exchange if the product purchased has a manufacturers fault or does not perform the task it is advertised to do, these issues are to be raised with Ansteys Healthcare within a ‘reasonable period of time’ from the purchase date, proof of purchase will be required for all refund/credit or exchange requests. Ansteys Healthcare reserves the right to determine what is a ‘reasonable period of time’ for the refund request on a case by case basis.

10. CANCELLATION OF GOODS.
The Company shall endeavour to meet Customer’s individual requirement but the Company shall be under no obligation to accept cancellation or amendment of any order or any part of an order. Where such cancellation or amendment is accepted it is on the understanding that a cancellation or amendment charge may be levied. There will be no cancellation of ‘special ordered’ goods under any circumstances.
11. PROOF OF DELIVERY.
Where a customer requests such proof and this is provided, the Company reserves the right to charge for any costs incurred in obtaining this information.
12. SPECIFICATIONS.
Descriptions and illustrations are accurate at time of publication. Due to continuing development, the Company reserves the right to supply later versions of the goods described. Every effort has been made to ensure the accuracy of the information contained in this website. However, the Company cannot be held responsible for any mistakes or for any damages resulting from the use of materials described herein.
13. LIABILITY AND INDEMNITY
We are not liable to you in any circumstances for: (a) any economic loss or damage including, any loss of revenue, profits, actual or potential business opportunities, contracts or anticipated savings or profits; (b) any indirect or consequential loss or damage; or (c) any loss or damage relating to the acts or omissions of any third party, and all other matters beyond our control.
To the extent permitted by law, we exclude all liability for breach of any express or implied term or warranty and also exclude all liability for negligence in respect of the performance of our obligations under this Agreement.
Where liability for any term implied by law cannot be excluded, and to the extent permitted by law, our liability for any breach of such an implied term is limited to (at our election): (a) in the case of services – the cost of having the services supplied again; and (b) in the case of goods – the lowest of the cost of replacing the goods, acquiring equivalent goods or having the goods repaired.
You must indemnify us against any damage, expense, loss or liability suffered or incurred in respect of your possession or use of the Equipment and the Consumables, unless and to the extent caused by our negligence.
14. WARRANTY INFORMATION
Ansteys Healthcare offers limited liability warranty on all products according to the specific manufacturer’s guidelines. We will repair or replace at our discretion and from the advise of the manufacturer. Proof of purchase will be required.
Limited Liability Warranty
Ansteys Healthcare supplied products are covered by a manufacturing limited liability warranty from defects in material and workmanship. This warranty does not apply if in the judgment of Ansteys Healthcare, the product fails due to damage from shipment, handling, storage, accident, abuse or misuse, or if it has been used or maintained in a manner not conforming to the product’s instructions, has been modified in any way or has a defaced or removed serial number or warranty seal.
Repair by anyone other than approved agent voids this warranty. The maximum liability of Ansteys Healthcare is the product purchase price. For details, refer to the product manual.
If your product is not covered under warranty, we offer a repair service at a cost which will be determined at the time of application.
